Overtime and Compensatory Time

WORK HOURS AND STAFF SCHEDULES

Work Schedules: The Federal Fair Labor Standards Act (FLSA) requires that employers must keep payroll records for employees.  Therefore, payroll records shall be maintained by the supervising manager for DeKalb Technical College non-exempt employees. The information must include the following:

1.      Employee’s full name;

2.      Employee’s department or functional area;

3.      Employee’s working hours: time of day and day of week when employee’s workweek begins and ends;

4.      Designated daily meal period;

5.      Total hours worked each workweek.

Work Hours: All full-time employees will generally be scheduled to work 40 hours per week exclusive of time off for meals.  The supervising manager must establish the individual work schedules of subordinates to ensure that each office or functional unit is adequately staffed during hours of normal school operations.  Full Time employees may work a prorated schedule if approved by the President. The prorated schedule will be a fixed number of hours per week.  Employees who work less than 75% time will not be eligible for employee benefits.

1.      Required work hours shall be either eight and one-half hours (to include a thirty- minute meal period) or nine hours (to include a one-hour meal period).

a.      Meal periods are considered non-work time and must be at least thirty minutes long; employees shall not perform job duties during their meal periods.

b.      An employee may not lengthen a meal period, report later to work, or depart earlier from work by foregoing or “working through” a meal period or break.

2.      Except in cases of emergencies, deviation from the approved work schedule must be authorized in advance by the supervising manager.

3.      Overtime, including FLSA compensatory time for non-exempt employees must be approved by the President in advance.

4.      Managers are encouraged to use flexible scheduling to avoid FLSA compensatory time or overtime payments (cash) so that non-exempt employees will not exceed 40 hours per week.

5.      There will be no compensatory time for exempt (i.e., professional) employees; however, flexible scheduling may be utilized.

6.      All managers are required to maintain records of hours worked by staff members.

7.      Violations of established work schedules will be considered cause for disciplinary action.
